Regulations of the Paid Parking Zone  (SPP)
and the Downtown Paid Parking Zone (ŚSPP)
within the Municipality of the City of Świnoujście

 

§ 1. General provisions

  1. These Regulations set out the rules for parking motor vehicles on public roads in the Paid Parking Zone and the Downtown Paid Parking Zone within the Municipality of the City of Świnoujście, as well as the method of collecting parking fees and additional fees.
  2. The Paid Parking Zone and the Downtown Paid Parking Zone are unguarded parking areas.
  3. Persons parking within the SPP and the ŚSPP are obliged to pay a parking fee.
  4. Vehicles referred to in Article 13(3) of the Act of 21 March 1985 on Public Roads are exempt from parking fees in the SPP and the ŚSPP.

§ 2. Definitions

  1. Whenever the Regulations refer to:
  1. SPP – this shall mean the Paid Parking Zone, as specified in Appendices No. 1 and 2 to the Resolution;
  2. ŚSPP – this shall mean the Downtown Paid Parking Zone, as specified in Appendices No. 1 and 2 to the Resolution;
  3. Sub-zone A – this shall mean a part of the Paid Parking Zone, the boundaries and list of streets included in which are specified in Appendices No. 1 and 2 to the Resolution;
  4. Sub-zone B – this shall mean a part of the Paid Parking Zone, the boundaries and list of streets included in which are specified in Appendices No. 1 and 2 to the Resolution;
  5. BSPP – this shall mean the Office of the Paid Parking Zone and the Downtown Paid Parking Zone in Świnoujście;
  6. Parking ticket – this shall mean a document confirming the period for which the parking of a vehicle in the SPP and the ŚSPP has been paid for, containing the vehicle registration number;
  7. Parking subscription card – this shall mean a document confirming that parking fees have been paid for a specified period, containing a registration number and the validity period, and additionally the vehicle registration number and the street name in the case of natural persons who are owners of a motor vehicle and whose place of residence is within the SPP or the ŚSPP, where such persons stay with the intention of permanent residence;
  8. Special subscription card – this shall mean a document containing a registration number, the vehicle registration number and the street or zone, intended for vehicles entitled to a zero parking fee rate in the SPP and the ŚSPP;
  9. Temporary subscription card – this shall mean a parking card issued in place of the original Parking subscription card or Special subscription card for the period of use of a replacement vehicle, available only in the event of damage to the vehicle covered by the subscription and valid for the period confirmed by the document of release of the replacement vehicle, not longer than the validity period of the original subscription;
  10. Mobile payment system – this shall mean a system adopted by the Operator of the SPP and the ŚSPP, in which a mobile device is used to pay fees in the SPP and the ŚSPP;
  11. Resident of the Paid Parking Zone – this shall mean a natural person whose place of residence is within the SPP and the ŚSPP, where that person stays with the intention of permanent residence;
  12. Parking card of a disabled person – this shall mean the document referred to in Article 8 of the Act of 20 June 1997, the Road Traffic Law (Journal of Laws of 2024, item 1251, as amended);
  13. Parking time:

a) valid – this shall mean parking time documented by a parking ticket, a parking subscription card or a mobile payment;

b) invalid – this shall mean parking time without payment of the required fee, confirmed by an additional fee document;

  1. SPP and ŚSPP Controller – this shall mean a person authorised to inspect parking fee payments in the SPP and the ŚSPP;
  2. Envelope – this shall mean a reserved parking space used on an exclusive basis;
  3. Parking meter – this shall mean a fee collection device issuing parking tickets;
  4. Mobile payment – this shall mean a fee paid using a dedicated application;
  5. Additional fee document – this shall mean a notice issued by a Controller in the event of failure to pay for parking in the SPP and the ŚSPP, containing vehicle data and information on the amount and method of payment of the additional fee;
  6. E-control system – this shall mean an automated system for verifying payment of parking fees, using ANPR cameras;
  7. Operator – this shall mean an external entity entrusted with the organisation and management of the SPP and the ŚSPP;
  8. Traffic management authority – this shall mean the Mayor of the City of Świnoujście, i.e. the competent authority pursuant to Article 10 of the Act of 20 June 1997, the Road Traffic Law (Journal of Laws of 2024, item 1251, as amended).

§ 3. Rules for collecting fees

  1. Parking fees in the SPP and the ŚSPP are collected in the amounts specified in Appendix No. 3 to the Resolution.
  2. In the SPP, fees apply:

a) from Monday to Friday in months I, II, III, IV, X, XI, XII from 9:00 a.m. to 6:00 p.m.;

b) from Monday to Friday in months V, VI, VII, VIII, IX from 8:00 a.m. to 10:00 p.m. – Sub-zone A, and from 8:00 a.m. to 8:00 p.m. – Sub-zone B;

excluding public holidays.

  1. In the ŚSPP, fees apply from Monday to Sunday, 24 hours a day.
  2. The boundaries of the SPP and the ŚSPP are specified in Appendix No. 1 to the Resolution.
  3. The areas of the SPP and the ŚSPP are marked with road sign D-44 “Paid parking zone” and, at exits, with road sign D-45 “End of paid parking zone”. In the paid parking zone, parking spaces for motor vehicles are designated by vertical signs D-18 “parking”, D-18a “parking – reserved space” and by horizontal road markings: P-18 “parking space”, P-19 “line marking a parking lane”, P-20 “reserved space – envelope”.
  4. Fees for parking lorries or vehicles with a gross vehicle weight exceeding 3.5 t in permitted spaces shall be determined as the product of the number of spaces occupied, assuming 6 m per space, and the rates specified in Appendix No. 3.

§ 4. Entitlements to a zero fee rate

  1. A zero parking fee rate is introduced for the following vehicles:

a) permanently marked vehicles of the Municipal Guard and Komunikacja Autobusowa sp. z o.o.;

b) vehicles marked with the disabled person symbol; during parking, the driver is obliged to place the disabled person’s parking card behind the front windscreen of the vehicle;

c) vehicles of carers of persons incapable of independent existence who reside in the SPP or the ŚSPP;

d) permanently marked service vehicles while performing duties related to the maintenance or repair of equipment located within road lanes, including district heating emergency services, electricity emergency services, gas emergency services and water and sewage emergency services;

e) enterprises and entities with which the road administrator has concluded contracts concerning technical services for the city or to which a decision has been issued for occupation of the road lane;

f) nurses and midwives while providing care to patients;

g) persons acting as foster families;

h) Honorary Citizens of the City of Świnoujście;

i) Honorary Blood Donors;

j) Honorary Transplant Donors.

  1. The persons and institutions referred to in paragraph 1 points c)–j) are obliged to submit a written application to the BSPP for the issue of a Special subscription card and to attach copies of documents confirming their entitlement to apply for a zero fee rate.

§ 5. Subscription cards, hybrid vehicles

  1. A parking subscription card for a Resident of the Paid Parking Zone and the Downtown Paid Parking Zone shall be issued upon a documented application submitted by an authorised road user.
  2. A natural person applying for such a card is obliged to present proof of residence, to present a document confirming that he or she is the owner of the vehicle, where ownership is confirmed by an entry in the vehicle registration certificate, or that such person has the vehicle at his or her disposal under a leasing agreement, lending-for-use agreement, rental agreement or lease agreement. A natural person may apply for a card for only one motor vehicle.
  3. A Special subscription card shall be issued for a period of up to 12 months, with the possibility of extension upon submission of an appropriate application and verification of entitlement.
  4. In the event of damage to or loss of a vehicle for which a Parking subscription card or Special subscription card has been issued, it is permissible to exchange such a card during its validity period for a Temporary subscription card with the registration number of the replacement vehicle entered, provided that all of the following conditions are met:

a) the applicant presents a document confirming damage to or loss of the vehicle, such as a police note, damage or loss report confirmed by the insurer, or a certificate from a repair workshop;

b) an individual agreement with the insurer or repair service, or another document confirming the release of a replacement vehicle for a specified period, is presented;

c) the original subscription card is returned.

  1. A subscription card for a replacement vehicle shall be issued for the period of use of the replacement vehicle, but not longer than the validity period of the original subscription.
  2. The subscription card referred to in paragraph 4 point c) shall be kept at the Operator’s registered office and returned to the applicant only after the prior return of the Temporary subscription card.
  3. The expiry date of the issued Temporary subscription card and the vehicle registration number, in relation to the original document, shall not be changed.
  4. An annual fee of PLN 5.00 for a parking subscription card shall be available to holders of the “Karta Wyspiarza” or “Karta Wyspiarza Seniora” who have at their disposal a vehicle:

a) with hybrid drive, whose CO₂ emissions do not exceed:

  • 100 g/km according to the NEDC standard, for urban conditions, or
  • 100 g/km according to the WLTP standard, for low values;

b) with CO₂ emissions not exceeding 50 g/km according to the NEDC or WLTP standard, weighted value in the combined cycle;

c) powered by hydrogen, compressed natural gas (CNG) or liquefied natural gas (LNG).

CO₂ emission values shall be determined in accordance with European Union provisions on vehicle type-approval, in particular Regulation (EC) No. 715/2007 and Commission Regulation (EU) 2017/1151.

  1. In the case of the vehicles referred to in paragraph 8 above, a written application must be submitted to the BSPP together with the following documents:

a) the vehicle registration certificate with an entry confirming that the vehicle has the drive referred to in paragraph 8 above;

b) the EC certificate of conformity or type-approval certificate confirming the standards specified in paragraph 8 above;

c) a leasing agreement, lending-for-use agreement, rental agreement, lease agreement or another agreement authorising the driver to use the vehicle.

  1. The holder of a “Karta Wyspiarza” or “Karta Wyspiarza Seniora” may exercise the entitlement specified in paragraph 8 above, provided that the registration number is reported in the application for the issue of the above-mentioned cards or in a reported change. The change shall be entered into the SPP and ŚSPP database within 3 working days from the date of notification. If the above deadline is not met, the entitled person shall be entitled to a refund of the amount due for the period subject to exemption from the fee.

§ 6. Holder of a “Karta Wyspiarza” or “Karta Wyspiarza Seniora”

  1. Holders of a “Karta Wyspiarza” or “Karta Wyspiarza Seniora” are entitled to a zero rate for parking a motor vehicle:
  1. in the Paid Parking Zone – for a period not exceeding 3 hours per day from Monday to Friday;
  2. in the Downtown Paid Parking Zone:

a) for a period not exceeding 3 hours per day from Monday to Friday;

b) without any time limit on Saturdays and Sundays.

The parking periods referred to in paragraph 1 point 1) and point 2) letter a) shall not be added together.

  1. The entitlements referred to in paragraph 1 are available provided that the vehicle registration number is indicated in the application as part of the procedure for issuing a “Karta Wyspiarza” or “Karta Wyspiarza Seniora”. The driver may divide the available time limit referred to in paragraph 1 into shorter periods lasting at least 15 minutes or multiples of 15 minutes.
  2. In the event of a change of motor vehicle, the holder of a “Karta Wyspiarza” or “Karta Wyspiarza Seniora”, in order to continue using the entitlement, is obliged to notify the issuer of those cards of the change so that the SPP and ŚSPP database can be updated.
  3. The holder of a “Karta Wyspiarza” or “Karta Wyspiarza Seniora” may exercise the entitlement specified in paragraph 1 provided that he or she obtains a ticket from a parking meter and enters the correct vehicle registration number or does so via the mobile payment system. The registration number should match the number reported in the application for the issue of the above-mentioned cards or in a reported change.
  4. A change of registration number shall be entered into the SPP and ŚSPP database within up to 3 working days from the date of notification. If the above deadline is not met, the entitled person shall be entitled to a refund of the amount due for the period subject to exemption from the fee.

§ 7. Reserved parking spaces

  1. For entities conducting hotel or guesthouse activities with their registered office in the Downtown Paid Parking Zone and Sub-zone A of the Paid Parking Zone, it is permissible to designate a reserved parking space, an “envelope”, for a period of at least 12 months, with a maximum of 3 spaces per facility.
  2. The reserved parking space referred to in paragraph 1 is intended for coaches or buses transporting hotel guests to and from such facilities.
  3. The flat-rate fee for one space is PLN 1,250.00 per month.
  4. The condition for designating an envelope is the consent of the Traffic management authority and payment of the fee referred to in paragraph 3 above.

§ 8. Drivers’ obligations regarding fees

  1. The driver of a vehicle parked in the SPP or the ŚSPP is obliged to pay a parking fee.
  2. The fee may be paid:
  1. by purchasing a parking ticket from a parking meter for the expected parking time;
  2. by purchasing a parking subscription card at the BSPP;
  3. using the mobile payment system.
  1. If it is not possible to pay the parking fee at a parking meter, the driver of the vehicle is obliged to pay the fee at another functioning parking meter or using the mobile payment system.
  2. A parking ticket purchased in the SPP or the ŚSPP entitles the holder to park only within the same zone, within the paid time, subject to the following paragraphs.
  3. A ticket purchased in an SPP sub-zone with a higher rate entitles the holder, during its validity period, to park also in a zone or sub-zone with a lower rate.
  4. A parking subscription card entitles the holder to unlimited parking in available spaces within the zone and sub-zone for which it was issued.
  5. A parking ticket from a parking meter must be purchased immediately after parking the vehicle, but no later than within 10 minutes from the moment of parking.
  6. When purchasing a ticket at a parking meter, the registration number of the parked vehicle must be entered.
  7. Mobile payment for parking a vehicle must be made immediately after parking the vehicle, but no later than within 10 minutes from the moment of parking.
  8. Fees paid at a parking meter or via a mobile application are non-refundable.
  9. Parking lasting longer than 10 minutes after the expiry of the time indicated on the parking ticket issued by the parking meter or after the end of the period paid for via the mobile payment system shall be deemed parking without payment of the required fee.
  10. In the event of exceeding the paid parking time of a vehicle, a notice to pay an additional fee for further parking shall be issued no earlier than 10 minutes after the time indicated on the parking ticket issued by the parking meter, and in the case of mobile payments, from the moment the paid parking period expires.
  11. If another parking ticket concerning the same vehicle is purchased before the expiry of the previous ticket, the validity periods of the tickets shall be added together only if the next ticket was purchased no earlier than 15 minutes before the expiry of the previous ticket. In all other cases, the validity periods of the tickets shall not be added together.

§ 9. Additional fee

  1. If unpaid parking is identified, whether by a controller or by the e-control system, an additional fee document shall be issued. In the case of a control carried out by a controller, the document shall be placed under the windscreen wiper of the vehicle; in the case of an infringement identified by the e-control system, the document shall be generated electronically and then forwarded for delivery to the vehicle owner or another entity responsible for the vehicle through a postal operator.
  2. The driver or owner of the vehicle may submit a complaint against the issued additional fee document within 7 calendar days from the date of its issue. The complaint shall be submitted to the Operator of the SPP and the ŚSPP through the Office of the Paid Parking Zone.
  3. If the complaint is not accepted, is submitted after the deadline or in a manner other than that specified in paragraph 2 above, this shall result in the obligation to pay the additional fee.
  4. Submission of a complaint does not suspend the time limit for payment of the additional fee.
  5. The additional fee may be paid by bank transfer to the indicated account number, at parking meters or at the Office of the Paid Parking Zone.
  6. If the additional fee is not paid within 14 days from the date of delivery of the payment notice, the amount due shall be collected under the provisions of the Act on Enforcement Proceedings in Administration.

§ 10. Control of fee payment

  1. Authorised employees of the Office of the Paid Parking Zone (BSPP), holding an identification badge and appropriate authorisation, as well as the e-control system, are entitled to inspect the payment of parking fees in the SPP and the ŚSPP.
  2. The duties of controllers include:

a) checking the validity of parking tickets, subscription cards and fees paid by mobile means, as well as verifying those fees within the e-control system;

b) issuing additional fee documents in the event of unpaid parking or exceeding the paid time, both during direct control and on the basis of the results of the e-control system;

c) placing the additional fee document in a visible place on the vehicle, in the case of a control carried out directly by a controller;

d) documenting controls, including recording the results of controls carried out using the e-control system.

  1. The e-control system may be operated using a vehicle equipped with a set of cameras recording vehicle registration numbers and using stationary devices installed within the SPP and the ŚSPP. The system operates automatically by comparing vehicle registration numbers with a database containing information on fees paid, subscriptions purchased or entitlements to fee exemptions.
  2. Data, including the image of the vehicle and its registration number, recorded within the e-control system are processed exclusively for the purpose of verifying the correctness of parking fee payments. These data are processed in accordance with the GDPR and the Act on Personal Data Protection, and their retention period is limited to the time necessary to perform tasks arising from legal provisions.

§ 11. Office of the Paid Parking Zone (BSPP)

The BSPP performs tasks in the field of organisation and management of the SPP and the ŚSPP within the Municipality of the City of Świnoujście, in particular:

  1. issues and collects fees for parking subscription cards and special subscription cards;
  2. collects fees for unpaid parking;
  3. gathers data on unpaid parking events submitted by controllers;
  4. forwards to the Świnoujście City Hall a list of unpaid amounts due in order to initiate enforcement proceedings;
  5. keeps records of issued subscription cards and sold parking spaces;
  6. settles accounts with the Świnoujście City Hall in respect of parking fees;
  7. presents to the Mayor of the City of Świnoujście applications concerning the functioning and development of the SPP and ŚSPP system.
